Major practice areas

A major component of the Firm's practice consists of representing financial institutions, such as commercial banks, asset-based lenders and hedge funds, in a variety of legal contexts, including loan documentation and workout, real estate, mergers and acquisitions, bankruptcy proceedings, litigation and alternative dispute resolution. Attorneys engaged in a particular matter draw upon the Firm's wealth of knowledge from all of our practice areas in order to provide our clients with not only the highest quality legal representation, but also the greatest efficiency.

We have significant litigation expertise representing our clients in Federal and State court proceedings at both the trial and appellate levels and Bankruptcy Court proceedings, as well as in arbitration and mediation proceedings. These proceedings have involved a broad spectrum of commercial disputes, including cases arising out of the debtor-creditor relationship (such as matters involving lender liability and disputes among competing lenders in problem loan situations), commercial tort and contract actions, real estate litigation, and defense of consumer and commercial class actions. We are proud of both the success we have achieved for our clients when they are obliged to initiate or defend legal proceedings, and our success in avoiding such proceedings by appropriate counseling, advice and negotiation.

Our attorneys have developed the specialized skills necessary to structure, negotiate and document secured and unsecured loan transactions, including working capital loans, letters of credit and other forms of trade finance, and financing for leveraged acquisitions, as well as the acquisition of loan portfolios and the offices and personnel that service them. In the complex area of loan restructuring, our attorneys are particularly adept at assisting our clients in evaluating a proposed restructuring and have the expertise to provide creative solutions to difficult business and legal problems. Otterbourg has a long and successful history representing committees of unsecured creditors in large and complex bankruptcy reorganization cases throughout the United States. We also regularly represent individual institutional lenders, bank groups, commercial enterprises and other secured or unsecured creditors in bankruptcy reorganization proceedings.

In our corporate and real estate practice areas, we represent diverse public and private companies in a broad array of corporate, securities and technology matters. We have particular expertise in the areas of real estate finance, complex leasing and acquisitions and sales of all types of commercial properties.
